1. Acceptance of Terms
By downloading, installing, or using the CouchLink application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
We reserve the right to modify these Terms at any time. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
2. No Affiliation with Microsoft or Xbox
CouchLink is an independent, third-party application. It is not affiliated with, sponsored by, authorized by, endorsed by, or in any way officially connected with Microsoft Corporation, Xbox, Xbox Game Studios, Xbox Game Pass, Xbox Cloud Gaming, or any other Microsoft brand, product, or service. The names "Xbox," "Microsoft," "Game Pass," and related marks are registered trademarks of Microsoft Corporation. All rights in those marks belong to their respective owners.
CouchLink accesses Microsoft's publicly documented and consumer-accessible streaming services solely for the purpose of providing a streaming interface to end users who hold valid, lawful subscriptions to those services.
3. Eligibility
You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms.
4. License to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control, solely for your personal, non-commercial gaming and entertainment purposes.
You may not:
- Copy, modify, or distribute the App or its content
- Reverse engineer, decompile, or disassemble the App
- Use the App for any unlawful, harmful, or fraudulent purpose
- Circumvent or attempt to circumvent any security measures in the App
- Use the App in a way that violates the terms of service of any third-party service it connects to
5. Third-Party Services and Subscriptions
The App requires valid third-party accounts and subscriptions (e.g., a Microsoft account with an active Game Pass Ultimate subscription) to function. You are solely responsible for:
- Obtaining and maintaining such subscriptions
- Complying with the terms and conditions of those third-party services
- Any fees charged by those third parties
We are not responsible for any changes, restrictions, interruptions, or terminations of third-party services that may affect the functionality of the App.
6. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the App will be uninterrupted, error-free, or free of harmful components
- Warranties regarding the accuracy, reliability, or completeness of any content or results
We make no warranty that the App will be compatible with any specific device, operating system version, game, or third-party service configuration.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COUCHLINK, ITS DEVELOPERS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, goodwill, or business opportunities
- Damages arising from your reliance on the App or inability to use the App
- Damages arising from unauthorized access to or alteration of your data
- Damages arising from interruptions or changes to third-party services
Even if we have been advised of the possibility of such damages, and even if a remedy set forth herein is found to have failed its essential purpose.
In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law — and in no event shall our total liability to you for any claim exceed USD $10.00.
8. Indemnification
You agree to indemnify, defend, and hold harmless CouchLink and its developers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; or (c) your violation of any rights of another party.
9. Intellectual Property
All original content, design, code, and trademarks of CouchLink are the property of CouchLink. Third-party marks (including Microsoft, Xbox, Game Pass, Apple, and related brands) belong to their respective owners. Nothing in these Terms grants you any right to use any third-party marks.
10. Compliance with Platform Rules
Your use of the App is also subject to Apple's App Store Terms and Conditions. In the event of a conflict between these Terms and Apple's terms, Apple's terms shall control with respect to App Store usage.
11. Termination
We may terminate or suspend your access to the App at any time, without notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California.
